Acquitted driver in governor death case to demand compensation

NOVOSIBIRSK, March 25 (RIA Novosti, Maxim Koshmarchuk) - Driver Oleg Shcherbinsky, acquitted in the road accident case that caused the Altai Territory governor's death in August 2005, will demand compensation for the damage inflicted upon his car, his lawyer said Saturday.

"Shcherbinsky will demand compensation through the insurance company [that insured the governor's car] in line with the law," Sergei Shmakov said.

The regional court closed the case against Shcherbinsky on Thursday, citing lack of evidence, and ruled that the man, sentenced to four years in prison, be released from custody.

Mikhail Yevdokimov, a former stand-up comedian, died last August when his official Mercedes, reportedly traveling at about 200 kilometers per hour (about 125 mph), smashed into a tree after colliding with Shcherbinsky's Toyota.

Yevdokimov's chauffeur and bodyguard were also killed in the accident, but his wife survived. Investigators said Yevdokimov's car had right of way as it was traveling with its flashing lights on.

Shcherbinsky's conviction triggered a nationwide wave of protests by motorists, who said he was being scapegoated.

A lawyer for Yevdokimov's widow said he would not appeal a regional court's decision to quash the verdict against the driver originally found guilty of causing the accident.
