LEAD - Former FSB operative arrested in Moscow

MOSCOW, September 18 (RIA Novosti) - Former FSB operative Mikhail Trepashkin, who had been earlier released from a correctional facility, was arrested in Moscow, his wife said Sunday.

Tatyana Trepashkin said her husband had been arrested in absence of his lawyers.

Trepashkin's lawyer Valery Glushenkov said, though, his client's arrest was legal.

"The court has reversed its decision to release Trepashkin on parole, therefore his status has changed," the lawyer said.

"The way the arrest was conducted is a different matter. Why would they arrest my client at home, if they could have simply called him and asked him to appear in a certain place at a certain time," he added.

The former FSB colonel has been sentenced to five years in prison for revealing state secrets and illegal possession of firearms.

According to investigation, while serving in the KGB and the FSB from 1984 till 1997, Trepashkin made copies of confidential documents and kept them illegally at home.

In October 2003, Trepashkin was arrested after the police found a handgun in his car.

Trepashkin insisted the gun had been planted in his car and the case against him had been fabricated.

In July 2005, the court reversed illegal possession of weapons charges against Trepashkin, but upheld the main judgment on divulgence of state secrets.

Trepashkin was released from a correctional facility on conditional parole, spending about a year and a half behind bars.

However, the court reversed its decision to release Trepashkin on parole on September 16 and he was arrested again Sunday.
