ROKHLIN VS. RUSSIA: STRASBOURG COURT COMES UP FOR GENERAL'S WIDOW

PARIS, April 7 (RIA Novosti) - Tamara Rokhlin, accused of murdering her husband, Russian parliamentarian General Lev Rokhlin, has won her case against Russia in the European human rights court. It is circulating the verdict as printed matter on its Strasbourg HQ.

In her complaint, Mrs. Rokhlin was appealing against her unduly prolonged pre-trial detention and criminal proceedings procrastinated in Russia.

Whatever pre-trial detention arrangements automatically fall out of compliance with the European human rights convention, Clause 5, Para. 5, which stipulates the right of being tried within reasonable time limits and of remaining out of custody throughout court proceedings. Pre-trial detention shall come as an exceptional measure to limit the right to freedom in precisely specified instances. Upon examining the file, the European court found no sufficient grounds for the plaintiff's long detention.

Russian court proceedings on the case took more than six years to violate the human rights convention, Clause 6, Para. 1, which stipulates the right to have unbiased court hearings within reasonable time limits.

The verdict recognizes Russia's trespasses, and entitles Mrs. Rokhlin to 8,000 Euro moral damages.
