German Tornados in Syria Flying Into Legal Storm

While Russia is carrying out its air campaign against terrorists in Syria at the invitation of the Syrian government, Germany's decision to join the US-led alliance has questionable legal justification, German experts told RIA Novosti.

Germany's decision to supply the US-led coalition in Syria with reconnaissance planes, a naval frigate, and aerial refueling jets has an unclear legal basis, German experts told a video conference in Moscow on Friday.

"Russia's actions in Syria are of course legitimate, the Syrian government invited Russia, which is observing international law there," said retired German army colonel Jochen Scholz at the conference, which was called "The fight against terrorism. The view from Moscow and Berlin," and took place simultaneously in the Russian and German capitals on Friday. 

"In Germany politics is not supposed to involve itself in military affairs, therefore international legal conditions must be clearly and precisely considered before the state gets involved in a military operation."

"With regards to the terrorist acts in Paris – was that an attack from one state, for example Daesh, on another state, or was it a terrorist criminal act? That is, how do we evaluate this from a legal point of view? From my point of view it was a criminal act."

"We are coming at this issue from a different position to the Russians. Russia is acting from an absolutely legitimate point of view … politicians have to decide how we (Germany) will battle with this Islamic extremism," explained Scholz.

On December 4 the Bundestag approved the German government's proposals to join the US-led coalition against Daesh in Syria by providing support to members of the coalition taking an active role. Germany is spending 134 million Euros on the operation, which has a mandate until the end of 2016. 

The German armed forces are providing Germany's Augsburg naval frigate, use of the SAR-Lupe military reconnaissance satellite system, six Tornado reconnaissance jets, an aerial refueling aircraft and up to 1,200 soldiers who will operate the equipment at the disposal of the coalition.
