"The European Court’ of Human Rights found a violation of of Article 5 § 1 [right to liberty and security] in the case of J.N. v. the United Kingdom (no. 37289/12). As just satisfaction, the court awarded EUR 7,500 (non-pecuniary damage) and EUR 10,000 (costs and expenses) to the applicant, Mr J.N., an Iranian national, born in 1971, who lives in Barking (UK)," the statement reads.
According to the statement, in January 2003, the Iranian national arrived in the United Kingdom and claimed asylum. However, the claim was refused. Later, he was convicted of indecent assault and sentenced to 12 months’ imprisonment. When the sentence was completed, he remained in immigration detention for 55 months: from March 2005 to December 2007 and from January 2008 to December 2009.
In 2009, he was released and granted permission to apply for a judicial review by the High Court.
