In a suit brought to the Moscow Arbitration Court today, the Yukos demands that the ministry and Mr. Golikov denounce a ministerial statement to the Prosecutor General's office, which alleges tax evasion to 150 billion roubles-slightly above US$5 billion. The company has offered to the law court all papers necessary to prove that it has paid its taxes in full, says the Yukos chief of PR.
As a tax inspection enactment offered to the company, December 29, has it, the Taxation Ministry charges the Yukos with an illegal arrangement to bring fiscal rates down. The Yukos forwarded objections to the ministry a week ago. It demanded from the ministry a resolution not to bring the company to trial for alleged tax evasion, and not to fine it.
As the company sees it, the enactment made conclusions that clashed with the federal Constitution, judicial stances of the federal Constitutional Court, and numerous provisions of the Tax Code.
The enactment of December 29 estimates unpaid Yukos taxes at more than 98 billion roubles, fines considered.
