US Army Sgt. Bowe Bergdahl has opted for a military judge, not a jury to hear the case that he deserted his post in Afghanistan, Army Times reported on Monday.

WASHINGTON (Sputnik) — A defense lawyer said last week that Bergdahl chose a judge to hear the case instead of a jury of military officers.

Bergdahl is accused of putting fellow soldiers at risk by leaving his post in Afghanistan in 2009. He faces a maximum sentence of life in prison on charges of desertion and misbehavior.

The soldier was captured by the Taliban and held for five years until former President Barack Obama’s administration approved a prisoner swap for five Taliban prisoners.

US President Donald Trump has criticized Bergdahl and Obama’s decision, leading his lawyers to question whether the soldier can get a fair trial.
