MH17 Crash Probe Must Be Similar to Ones in States With Fair Justice System

An impartial judicial process like those held in countries with good criminal justice systems could have shed light on the mysterious crash of the MH17 airliner that killed hundreds in eastern Ukraine, but the process would take years, former Federal Bureau of Investigation (FBI) agent Coleen Rowley told Sputnik.

WASHINGTON, July 10 (Sputnik) – Next week, the UN Security Council will debate Malaysia’s proposal to set up an international tribunal to prosecute those responsible for downing the Malaysia Airlines MH17, though no side has been officially charged yet.

“Inside nation states with good criminal justice systems, judicial due process requires the best sharing of information and impartial investigation of the facts, and then, if probable cause is found to exist, the seeking of judicial accountability through trial.”

Talks on Creating UN Tribunal for MH17 Plane Crash Will Start Next Week

The case of Malaysian MH17 plane’s suspected downing is led by the Netherland since the majority of 298 casualties were Dutch citizens. A final report on the Dutch Safety Board’s secretive investigation is due to be published in October.

Russian envoy to the United Nations Vitaly Churkin said earlier this week that the draft resolution fails to correctly classify the crash, adding that international tribunals have never been created following incidents with civilian aircraft.

Ex-FBI operative-turned-whistleblower Rowley stressed that judicial fairness has become especially important these days where tensions have been ratcheted up between Russia and the United States.

She warned that international brinkmanship and propaganda wars have recently “caused the Doomsday Clock to be pushed even closer to midnight,” putting the world on the edge of an all-out nuclear exchange.

“So I would not be opposed to a cooler-headed judicial evaluation if warranted by preliminary investigation and supported by full discovery of all the facts now possessed by different countries.”

A Malaysia Airlines plane heading from Amsterdam to Kuala Lumpur crashed July 17 near the city of Donetsk in Ukraine, killing all 298 people on board.

Kiev blamed the independence supporters in eastern Ukraine for shooting down the plane. However, local militia insisted that they did not possess weapons capable of bringing down an aircraft flying at 32,000 feet.

Russia has repeatedly stressed the importance of a transparent international investigation.
