A federal judge in California has dismissed claims from a US adult content publisher that the Russian search engine Yandex directly infringed its copyright, Bloomberg reported Monday.

WASHINGTON, July 22 (RIA Novosti) – A federal judge in California has dismissed claims from a US adult content publisher that the Russian search engine Yandex directly infringed its copyright, Bloomberg reported Monday.

Perfect 10, Inc. said in court that Yandex was hosting images of its content that had been uploaded to Russian servers without permission. The publisher argued that although the servers were located in Russia, US residents could potentially download the illegal images, Bloomberg reported.

US District Judge William Alsup ruled against Perfect 10 on July 12, stating that that there was no precedent for the argument that “display of a copyrighted image anywhere in the world creates direct copyright liability in the United States merely because the image could be downloaded from a server abroad by someone in the United States,” according to court documents.

The judge did however let stand Perfect 10’s claim that Yandex was “vicariously liable” for contributing to “others’ infringement,” Bloomberg reported.
