Court upholds $100mln tax claims against Moscow Oil Refinery

MOSCOW, January 11 (RIA Novosti) - Moscow's Ninth Arbitration Court of Appeals has rejected an appeal by the Moscow Oil Refinery against a back-tax claim of rubles 2.862 billion ($100 million) for 2001.

The court also dismissed an appeal by the tax authorities, which had claimed that in its first ruling the court had unjustifiably lowered the company's tax bill by $20 million.

The Moscow Oil Refinery - the capital's main fuel supplier - was also in court earlier this month, when an arbitration court overruled a decision by the appeals court against the refinery's payment of dividends to preferred stock holders.

The appeal had been filed by companies representing oil companies Sibneft and Tatneft, which both hold substantial stakes in the refinery. By receiving dividends on their preferred shares, the companies are unable to claim voting rights in the company.

The majority stake in Moscow Oil Refinery is owned by the Moscow city government in partnership with UK-listed oil firm Sibir Energy.
