EU SEES TWO WAYS FOR SETTLING UKRAINE -- LEGAL AND POLITICAL

THE HAGUE/VIENNA, November 25 (RIA Novosti) - The European Union sees two ways for settling Ukraine - legal and political.

The first is when the case is taken to the court and a constitutional mechanism is set to work. The second is the way of dialogue and discussion, the foreign minister of The Netherlands, Bernard Bot, told RIA Novosti in the interview.

The Netherlands is the incumbent chair of the European Union.

"We think that everything possible should be done to settle the problem by the peaceful means. People are taking to the street because they think the election was dishonest. This question should be resolved. We should know who has really won in the election", the minister said.

He noted the need of avoiding violence in Ukraine and resolving the situation by peaceful methods.

Commenting on Victor Yschenko's proposal for a runoff, Bot said: "The authorities of a country should not be forced to make such a step because it only can be their own decision".

The foreign minister of The Netherlands said that the European union is not siding with any of the candidates but trying to ascertain whether or not the election has been free and fair.

Bot noted that the EU should base its assessment of the situation on reports by observers of the OSCE and other organisations. If violations have been discovered, Europe will send the corresponding opinion to the Ukrainian authorities.

Besides, The Netherlands as the EU chair country has sent to Ukraine a special envoy, who is now discussing election returns and the situation obtaining with Kuchma, Yanukovich, Yuschenko and other Ukrainian executives.

"We are expecting his report. I think we should go on with the political dialogue and make use of the mechanisms laid down in the Ukrainian constitution", Bot said.

As to the possibility of taking the case to court, Bot said that Ukraine is a sovereign country and this is why other countries, the European Union are not entitled to doubt the Ukrainian court will make a fair ruling.

On Friday Jan Kubish, secretary general of the Organization for Security and Cooperation in Europe, will arrive at Ukraine with a two-day visit, RIA Novosti learnt from the OSCE board for information and public relations in Vienna.

Kubish is going on site to see what is what there and find what share can the big regional organisation, made up of 55 member states, do for the political settlement in the post-election Ukraine.

At the request of the OSCE acting chairman and Bulgarian Foreign Minister Solomon Pasi, the OSCE secretary general will hold consultations with public figures, heads of political parties, representatives of the international community in Ukraine.

The OSCE said that, despite the declarations by ex-Polish President Lech Valenza that he has been appointed the OSCE envoy for Ukraine, the OSCE leadership has not taken such decisions.
