COUNTERFEIT PRODUCE AVALANCHE THREATENS RUSSIA'S SECURITY, WARNS EXPERT

MOSCOW, October 13 (RIA Novosti) - Russia must necessarily streamline its legislation on intellectual property rights protection, calls Rudolf Shabanov, Federal Industrial Property Institute staff expert.

"Counterfeit produce manufacture and circulation have reached such a scope in Russia as to become one of the threats to its state security," he said to a conference on intellectual property rights protection in Moscow today.

"To improve legislation on protecting rights of intellectual property and objects thereof, enhance liabilities for such trespasses, and to make administration of the law more effective to combat counterfeiting-all that has become essential parts of efforts against industrial piracy," stressed Mr. Shabanov.

Meanwhile, Russia's Criminal Code qualifies encroachments on intellectual property as mere misdemeanours or minor crimes. That has to change, he insists.

The expert deems it necessary to toughen the Code of Administrative Misdemeanours, in particular, increase fines for related acts, and introduce a clause that will demand destruction of equipment used to manufacture counterfeit items-not only of the produce itself, as the Code has it now.

The Trademark Law needs an amendment to envisage cessation of counterfeiting and damage payments at once. In that, payments must necessarily equal the actual damage done, Rudolf Shabanov pointed out.
