TOO EARLY TO PARDON BUDANOV, SAY PROSECUTOR'S MEN

MOSCOW, September 20 (RIA Novosti) - The Ulyanovsk regional prosecutor's officers do not think it reasonable to pardon Yuri Budanov now, says an office statement signed by Viktor Malyshev, top regional prosecutor, and forwarded to Vladimir Shamanov, regional governor. The statement has reached RIA Novosti.

The prosecutor's experts point out procedural violations made as Budanov's pardon application was considered.

Thus, the application was made without due account for the public danger of the convict's crimes, which the court qualified as grave and exceptionally grave-kidnap, murder in aggravating circumstances, and violent abuse of office that brought grave consequences, says the prosecutor's statement.

Budanov has been in prison only since November 11, 2003-too little to judge whether he has truly repented. The way the convict is described in the application for pardon clashes with his psychological portrayal, which warn to expect of him "violent outbreaks followed by moral-based emotions."

Budanov has for today served less than a half of his term, precisely four years, five months and 24 days, which is hardly enough for his correction, stress the prosecutor's experts.

The prison administration's application certainly clashes with hard facts, and pardon is presently ruled out, says the statement.

The pardon application bears the regional governor's signature.

Colonel Yuri Budanov, then in command of the 160th Tank Regiment, killed Elsa Kungayeva, Chechen girl of eighteen, in summer 2000. The North Caucasian district court martial made a verdict of "guilty", July 25, 2003. Budanov was convicted to ten years in a maximum-security prison, demoted in rank, and deprived of his Order for Valor.

Now, he is in convict camp No. 3 in Dimitrovgrad, Ulyanovsk Region.
