KHODORKOVSKI CRIMINAL CASE GOES TO MOSCOW DISCTRICT COURT

MOSCOW, May 14 (RIA Novosti) - The Khodorkovski criminal case has been sent for trial on its merits to a district court of Moscow, says the official site of the Russian Prosecutor General's Office.

It does not specify what court will consider the case of the former Yukos chief.

Earlier, Genrikh Padva, a lawyer for Khodorkovski, said it could be the Meschanski court of Moscow. Some time before, this court passed a sentence on Yukos-Moscow former head Vasili Shakhnovski. On May 20 Meschanski court will begin trial on the merits of the case of Platon Lebedev, head of the MFO Menatep.

"Today the Prosecutor General's Office of the Russian Federation has approved the criminal information on the case of ex-NK Yukos head Mikhail Khodorkovski and former general director of AOZT Volna Andrei Krainov", the office says.

According to it, Khodorkovski is accused of these crimes - big theft of others' property by cheating as a member of an organised group; malicious non-performance of court ruling in force by representatives of a commercial organisation; big property damage to the owners by cheating at no signs of theft by an organised group; repeated big avoidance of taxes from an organisation by a group of persons on premeditated arrangement; big individual avoidance of tax or insurance premium payments to the state extrabudgetary funds; repeated forgery of official documents; big appropriation or embezzlement of others' property by an organised group.

Krainov is accused on three articles of the Russian Criminal Code.

The criminal case on these persons is contained in 227 volumes, the Prosecutor General's Office says. According to it, investigation estimates the total of damage done by their actions at over one billion dollars.

Khdorkovski was detained on October 25, 2003 in the Tolmachevo airport of Novosibirsk and taken to Moscow on the same day, where the Basmanny court sanctioned his arrest.

In the figures of prosecution, the total of damage from Khodorkovski's and Lebedev's actions is worth over one billion dollars.

Khodorkovski is also accused as an individual of avoiding, in 1998-1999, the payment of income tax and insurance premium to the Pension Fund to a sum of 53 million roubles (1.7 million dollars).

Mikhail Khodorkovski is pleading not guilty. On November 3 he tendered resignation as the chairman of the board of the NK Yukos.
