MOSCOW (Sputnik) — The European Commission may sue Hungary in the European Court of Justice should the results of the proposed Hungarian referendum on the EU plan to resettle asylum seekers violate EU law, spokesperson of the Court of Justice Balazs Lehoczki told Sputnik Thursday.
"We should wait for the outcome of the referendum. But if it happens to be in violation of European law, if it results in the non-implementation of EU decisions which are binding for Hungary, in this case the European Commission can bring a lawsuit before the [European] Court of Justice", Lehoczki said.
The Hungarian government on Wednesday called a national referendum, where Hungarians will vote on the EU plan for mandatory quotas to resettle migrants in the bloc. The referendum proposal has already been submitted for approval to the National Election Commission.
"The case is in progress. The decision will be announced at the end of this year at the earliest," Lehoczki said.
Europe is currently struggling to handle a massive refugee influx, as hundreds of thousands of refugees and migrants flee conflict-torn countries in the Middle East and North Africa.
In September, the European Commission announced a quota scheme, providing for the resettlement of 160,000 refugees currently located in Greece, Italy and Hungary, throughout other European member states over the next two years.
