MOSCOW (Sputnik) — Previously, the European Union claimed that the ban, related to cases of African swine fever in several EU states, is inconsistent with a number of WTO articles as well as the Sanitary and Phytosanitary Measures Agreement (SPS).
"The Panel found that the EU-wide ban and the EU member State bans do not fulfill the conditions to qualify as provisional measures pursuant to Article 5.7…The Panel also found that Russia did not base the measures at issue on a risk assessment within the meaning of the SPS, thus breaching Articles 5.1 and 5.2," the statement said.
The panel said that the ban was discriminatory and in excess of what is required to reach appropriate levels of protections, as well as stating that a ban on certain products from Estonia, Latvia, Lithuania, and Poland is inconsistent with international animal health standards.
